After decades of debate over the need to regulate assisted reproductive technologies and surrogacy, the Indian Parliament passed the Surrogacy (Regulation) Act, 2021 and the Assisted Reproductive Technology (Regulation) Act, 2021. However, the Acts face legal challenges for their impact on privacy, women’s reproductive rights, and the exclusion of compensation for donors and surrogates. Issues have also arisen surrounding access for single women, non-traditional families, restrictive medical criteria, incongruent age restrictions, ambiguous definitions, limitations on individuals with existing children, and penalties for medical practitioners. We collaborated with Justice Adda to produce primers that simplify the Surrogacy (Regulation) Act, 2021 and the Assisted Reproductive Technology (Regulation) Act, 2021, to better understand these laws. We have also included an animation that helps explain the key features of the two Acts.
